MERCHANDISE SALES

  1.  By purchasing merchandise from Jolie Papillon you indicate that you agree and have read and understood these terms and conditions.
  2. Goods are NOT sold on a sale or return basis. Purchase is final and refunds will not be given.
  3. Should merchandise arrive damaged contact info@missjoliepapillon.com immediately with a description of the damage. We will advise you as to what to do on a case by case basis in order to best resolve the problem.
  4. All merchandise is sent descreetly in plain packaging material.
  5. Goods will be dispatched in a timely manner so as to arrive at the very latest within the UK within 28 days of ordering. Internationally please allow 56 days. Some items are dependant on stock and Jolie’s presence to personalize them – in this case please email for an update of delivery time.
  6. Any goods not yet dispatched may be cancelled and a full refund given.

ONLINE CLASS, CONSULTATION

AGE OF CONSENT
The Client confirms that the Client is aged 18 years or older and is eligible for boudoir photography services.

SERVICES
All Services to be provided under this Contract are listed in the individual product description at time of purchase.

PAYMENT
The Client agrees that all fees paid to Jolie Papillon are non-refundable. The Client agrees that this payment is earned by Jolie Papillon when paid, and is remitted in consideration of the experience, reputation, skill, and in consideration of the inability of the Jolie Papillon to schedule other clients during this time. No appointment is confirmed until this payment has been received.

CANCELLATION
If the Client requests to cancel this Contract or fails to be in the presence of Jolie Papillon either online or otherwise, on the agreed upon date and time, all Payment shall be forfeited. The Client is, however, permitted to transfer the Services provided under this Contract into another name. Notice must be given in writing to Jolie Papillon at least 24 hours before the appointment begins.

LATE ARRIVALS
Any Client that is late arriving to the event will have the amount of time late deducted from the time allotted for the event. Clients shall not be compensated for the time deducted from the event due to late arrival of the Client.

FAILURE TO PERFORM
If Jolie Papillon is unable to perform this Contract due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Jolie Papillon, every attempt to reschedule the session will be made. If a reschedule is unable to be agreed upon, the Jolie Papillon shall return any payment to the Client and shall have no further liability.

LIMIT OF LIABILITY
In the unlikely event of negligence, breach of Contract, failure to perform, inability to deliver the consultation due to technological malfunctions – including but not limited to the equipment operation and internet connection, or cancellation of this Contract by either party or in any circumstance, or cancellation of this Contract by either party or in any circumstance, the liability of one party to the other shall be limited to the total value of the Contract. Neither party shall be liable for indirect or consequential loss. Any legal matters will be dealt with in the jurisdiction closest to Jolie Papillon’s office. Any legal fees incurred by Jolie Papillon as a result of Client prosecution will be paid by the Client.

COPYRIGHT
All material (including text) on the site is the copyright of the photographers involved and of Jolie Papillon. Sharing the files by use of peer to peer systems (such as BitTorrent) or posting files to newsgroups or reuse on other websites or linking to pictures or text on this site are all strictly prohibited. Any use of the pictures other than for viewing purposes only is also strictly prohibited. Please consider that by stealing images or text in this way you are hurting Jolie Papillon directly and making continued operation of the website difficult. If you suspect piracy of pictures or text from the website please email info@joliepapillon.com with the URL of the site you suspect is misusing Jolie’s material.
